Enjoining against bigotry

A US judge has followed up her ruling last month that the military's "don't ask, don't tell" policy was unconstitutional with an injunction preventing them from enforcing it. The net result is that gays are now free to serve openly in the US military. Unless, of course, the government appeals. But having supported overturning the ban, Obama can hardly do that, can he?
